Service
These terms govern your use of the SoilSage website and the engagement of our gardening services. Please read them before submitting any service request.
1. Acceptance of Terms
By accessing or using the SoilSage website (soilsage.site or soilsage.online) or by engaging SoilSage LLC ("SoilSage," "we," "us," or "our") for any gardening service, you ("client" or "you") agree to be legally bound by these Terms of Service. If you are accessing our website or engaging services on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.
Soil Sage LLC is a licensed Colorado landscape contractor (License #CO-LS-001) located at 8323 Depew Way, Arvada, Colorado, USA.
Important: These Terms govern website use and general service terms. Each specific garden project is governed by a separate written service agreement. In any conflict, the signed service agreement prevails for matters relating to that specific project.
2. Website Use
Permitted Use
You may access and use our website to learn about our services, request consultations, read our Garden Notes articles, and contact us for legitimate purposes. You agree to use the website only for lawful purposes that do not infringe on others' rights.
Prohibited Activities
- Submitting false, fraudulent, or misleading information through any website form
- Attempting to gain unauthorized access to our website, servers, or systems
- Using automated tools to scrape or harvest data without written permission
- Reproducing or distributing SoilSage content without explicit written authorization
- Impersonating SoilSage, any SoilSage team member, or any other person or entity
- Transmitting malicious code through any SoilSage communication channel
3. Service Engagement
Submitting a consultation request, contact form, or any inquiry does not create a binding service contract. A binding contract for gardening services is formed only when both SoilSage and the client have executed a written service agreement specifying scope of work, materials, pricing, timeline, and applicable terms.
All services are further contingent on:
- Completion of a site assessment confirming project feasibility and conditions
- Receipt of any deposit specified in the written service agreement
- Client provision of adequate, safe, and legal access to the property
- Property conditions consistent with what was represented during the assessment
SoilSage reserves the right to decline any service engagement, including when a property is outside our service area, when site conditions present safety concerns, or when our scheduling capacity would compromise our quality standards.
4. Estimates, Proposals, and Pricing
Maintenance plan pricing shown on our website represents standard rates for residential gardens up to 400 square feet within our primary service area. This pricing is not a binding offer and does not account for property-specific variables. Binding project pricing is provided through a written proposal issued after an on-site assessment.
Written proposals are valid for 30 days from the date of issue. Pricing for design and installation projects varies based on garden size, complexity, material selection, site conditions, and current material costs. Maintenance plan pricing for larger gardens, commercial properties, and locations requiring a travel supplement will differ from standard published rates.
5. Harvest Guarantee
Clients enrolled in the SoilSage RootWork maintenance plan receive our harvest guarantee: if your garden does not produce a harvest of at least three distinct edible crops during the first full growing season under SoilSage management, we will credit one month of the RootWork plan fee.
The harvest guarantee applies only when all of the following conditions are met:
- The garden receives a minimum of 6 hours of direct sunlight daily throughout the growing season
- The client provides adequate, safe access to the property on all scheduled visit dates
- No unauthorized modifications to plants, soil, irrigation, or bed structure are made by the client or third parties between SoilSage visits
- The client follows watering guidance provided by SoilSage between visits
- The garden infrastructure (beds, irrigation, soil) meets the minimum standards confirmed at the initial site assessment
- The RootWork plan has been active for the full duration of the applicable growing season
The guarantee is limited to one month credit per growing season and does not apply to losses caused by extreme weather events, pest invasions beyond normal management scope, vandalism, or client action or inaction contrary to SoilSage guidance. "Harvest" means production of crops in quantities sufficient for household use, not commercial volume. See your written service agreement for complete guarantee terms and the crops that qualify.
6. Payment Terms
Standard payment terms for residential projects are a 30–50% deposit upon signing the service agreement, progress payments at agreed milestones for larger projects, and final balance due upon project completion and client walkthrough acknowledgment. Maintenance plan billing is processed monthly at the beginning of each service month.
Accepted payment methods include ACH bank transfer, major credit cards, and business check. Balances remaining unpaid beyond 15 days of the due date may accrue a finance charge of 1.5% per month on the outstanding balance. SoilSage reserves the right to suspend ongoing service obligations for overdue balances pending resolution.
7. Cancellation and Plan Changes
Installation Projects
Cancellation of a signed service agreement after material ordering has commenced may result in charges for ordered materials at actual cost, work completed through the cancellation date, and reasonable administrative costs. Specific terms are detailed in each written service agreement.
Maintenance Plan Cancellation
Maintenance plans may be cancelled by the client with 30 days' written notice delivered to hello@soilsage.site. No refunds are issued for the billing month in which notice is received. The plan remains active through the end of the final paid month.
Plan Tier Changes
Upgrades or downgrades between plan tiers require 14 days' written notice and take effect at the start of the next billing cycle. Billing adjustments reflect new tier pricing from the effective date of change.
8. Property Access and Client Responsibilities
By engaging SoilSage for on-site services, you represent that you are the property owner or have authorization from the property owner for the work to be performed. You agree to provide safe, adequate access to the garden areas at all scheduled service times.
You are responsible for informing SoilSage of any known property hazards including underground utilities, unstable structures, aggressive animals, or access restrictions before work begins. SoilSage is not liable for damage to undisclosed underground utilities or hazards not disclosed prior to site work.
9. Limitation of Liability
To the maximum extent permitted by applicable Washington State and federal law, SoilSage's total liability for claims arising from a specific service project shall not exceed the total fees paid by the client for that project in the 12 months preceding the claim. For website-only interactions not involving a service contract, our liability shall not exceed one hundred dollars ($100).
SoilSage shall not be liable for any indirect, incidental, consequential, or punitive damages arising from our services or website, including crop failures due to weather events, pest outbreaks, or client actions outside of SoilSage guidance. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Intellectual Property
All website content — including Garden Notes articles, the SoilSage name and logo, service names (Seedling, Harvest, RootWork), the SoilSage soil assessment protocol, and our growing calendars and planting documents — is the intellectual property of SoilSage LLC and is protected by applicable copyright and trademark law. You may share links and quote up to 150 words with attribution. Full reproduction requires written permission from hello@soilsage.site.
11. Results Disclaimer
Garden outcomes — including plant health, yield, pest resistance, and soil improvement — vary based on factors including but not limited to existing soil conditions, Seattle microclimate, plant variety selection, seasonal weather, client maintenance between visits, and pest and disease pressure beyond normal management scope. Testimonials, yield claims, and case studies on our website reflect individual client experiences and are not guarantees of identical outcomes for your specific garden and conditions.
Nothing in our website, marketing materials, or verbal communications constitutes a warranty of specific garden performance except as explicitly stated in a signed written service agreement or in our written harvest guarantee documentation.
12. Dispute Resolution
We encourage clients to contact us directly at the first sign of any concern — most issues are resolved promptly through direct communication. If a dispute cannot be resolved through direct discussion within 30 days of written notice, both parties agree to attempt mediation through a mutually agreed Washington State mediator before pursuing arbitration or litigation. Unresolved disputes shall be submitted to binding arbitration under AAA Commercial Arbitration Rules, conducted in King County, Washington.
13. Governing Law
These Terms are governed by the laws of the State of Washington. Subject to the arbitration clause, any court proceedings shall be brought in King County, Washington Superior Court, and you consent to personal jurisdiction there.
